What is the purpose of the Home Owners Association (HOA)?

The main purpose of the HOA is to promote community involvement for the Ponds Of Edinburgh homeowners and to ensure all applicable covenants and bylaws are followed that will help in sustaining the property values in the neighborhood.

Who or how was the association created?

The original developer of the area required the creation of the HOA to ensure a  pristine neighborhood.

Who are the current officers of the HOA?

For the 2004-2007 terms, the officers are-

What are the roles and responsibilities of the HOA officers or Board of Directors (BODs)?

Based on the HOA Covenant and By-laws, following are the general roles and responsibilities of the Board Of Directors-

 The President presides over the meetings of the Board of Directors and of the Association of Lot Owners, has all of the general powers and duties which are normally vested in the office of President of  a corporation and has the power to execute contracts and similar documents on behalf of the Association.

 In the absence of the President, the Vice President assumes and performs the duties of the President.

 The Secretary keeps the minute book of the Association wherein minutes of all meetings and all resolutions, proceedings and votes of the members and of the Board of Direc­tors shall be recorded, and keeps a record of the name and mailing address of each Lot Owner, and the Lot or Lots in which there is an interest and gives all notices required by the Articles of Incorporation of the Association, these Bylaws, or the Declaration. 

 The Treasurer keeps the financial records and books of account of the Association.  The Treasurer has custody of all intangible property of the Association, including funds, securities and evidences of indebtedness.  The Treasurer deposits all moneys and other valuable effects in the name of or to the credit of the Association in such depositories as may be designated by the Board of Directors and disburses the funds of the Association as ordered by the Board of Directors and performs all other duties incident to the office of Treasurer, including the annual review of the financial statements of the Association.  The Treasurer furnishes, upon request of any Lot Owner a statement, the current account of the Lot Owner upon the assessment rolls of the Association.

All other Officers (such as the Members At Large) are responsible for special projects as assigned by the BOD.

How much is the association fee?

The fee is currently $45.00 per year.

When is the Association Fee due?

The yearly association fee is due on February 1 of each year and is to be sent to the Treasurer.

 Is the fee seemed to be too excessive?

Actually the fee has been reduced from $85/year to $45/year and compared to other similar associations, it is deemed very reasonable.

 Where does the money collected from member fees go?

The money is spent on various maintenance related activities such as maintaining the HOA phone hotline and web site, mailbox upkeep, pond/grass maintenance, rock garden maintenance, and any other community activities undertaken by the BOD.

 How often and where the Board Members meet?

The BOD members usually meet every other months or on as needed basis.

 Can I come to the BOD meetings?

Sure. These are very informal meetings and any home owners can come and participate. We only request that you let us know in advance that you plan to come so that we can arrange for appropriate accommodations.

 Where can I get the covenants or bylaws documentation the HOA?

You can download them right from this website. Click here for the HOA Covenants and By-Laws. If you would like hard copies, please send $30.00 for the Covenants and $15.00 for the By-Laws to Rick Jellison, 9125 Yates Bay, Brooklyn Park, MN 55443.

I am planning on building a deck, do I need permission from the BOD? What do I need to do?

You need to send your deck plan to the -

Also note that there is a $100 review fee that needs to be attached to the plan.

 I am planning on Building a fence. What do I need to do for that?

Same as above. Note that there are some special restrictions on the type of fence that you can build. Please refer to the Covenants (section 6.13)

 I would like to build a Shed in my property, what do I do for that?

Unfortunately the Covenants do not allow any types of Sheds or similar structures to be built in the home owners property. Please see the section 6.11 for more information.
